Terms and Conditions
Use of any services offered by StudentWorx is dependant on your acceptance of these terms and conditions. The terms and conditions outlined here are subject to change from time to time and while every effort is made to alert our clients to any significant changes, clients should ensure that they have the most recent copy of this document, available on our website: http://www.studentworx.co.za
A. Common Terms used in this document:
StudentWorx:
Refers to the authorised and legitimate members, owners, staff and agents of the StudentWorx project, an initiative of Gabriel Innovative IT CC
The Client:
Refers to the individual or organisation entering into a contractual agreement with StudentWorx for the provision of labour, services and/or equipment.
Standard Hourly Rate:
For the purposes of this document and at the time of writing, the Standard Hourly Rate is R150 per hour unless stated otherwise in this document and/or agreed upon otherwise in writing by both the Client and StudentWorx.
B. Website Design and Development
1. Upon completion of the graphic design of the site, 1 mock-up (or more if agreed) will be provided to the client. The Client has 7 days to inform StudentWorx of any changes to this design (within the scope of the quotation). StudentWorx will make these changes. Once the graphic design has been approved and finalised, any further changes will incur a design fee at the Standard Hourly Rate.
2. Upon completion of the coded development of quoted items, StudentWorx will inform The Client of such completion. The Client will have seven days to review the site, and request any further changes, in line with the original quotation. Thereafter, the development will be deemed to have been accepted. Requested tweaks and amendments to items quoted will be done if applicable, and no further changes will be done within this quotation. Further changes will incur a development fee at the Standard Hourly Rate, or will require an additional quotation.
C. Hosting
1. The hosting price is available on an annual or bi-annual contract period, and is payable in advance for each period.
2. Renewal of hosting and domain services must be done 30 days in advance of expiration of the hosting or domain.
3. Hosting and maintenance is non-refundable, as hosting is paid to our service providers in advance.
4. Any waivers of set up fees and costs for statistics collation, as well as quoted discounts, are at the sole discretion of StudentWorx and may be changed from time to time, with such changes being outlined in a communication to the client and/or addition to these terms and conditions.
5. All site statistics must be requested by email. The first set of statistics will only be available 21 days after the first request.
6. Should technical advice be included in your contract with StudentWorx, the following conditions apply:
a. Communication must be user-originated (by The Client).
b. If StudentWorx personnel are not available telephonically, we will reply via email. Should StudentWorx be required to call The Client, the consultation will be billed to The Client at the Standard Hourly Rate.
c. SMS communication may originate from StudentWorx if we are not at a computer and the communication is urgent. If SMS communication is used excessively or regularly, the communication will be billed to The Client as a consultation at the Standard Hourly Rate.
d. Technical advice is limited to issues pertaining to your contract. Should additional advice beyond the scope of The Client’s contract be required, and this advice takes more than 15 minutes (including research and internal communication), then the consultation will be billed to The Client at the Standard Hourly Rate.
7. Should The Client cancel a hosting contract for any reason, there will be no refund of any hosting amounts paid. StudentWorx will only transfer the domain to a new service provider once all outstanding amounts have been paid in full, as well as any unpaid interest on overdue accounts.
8. While every care is taken to ensure optimal functioning of our software and hardware systems, The Client agrees to indemnify, absolve and not hold StudentWorx responsible for any resultant effect of unplanned downtime, loss of email services, or malfunction/non-function of software and/or systems including and not limited to any associated loss of business or income.
D. Domain Registration and Renewal
1. First year registration or reservation fees may only be waived at the discretion of StudentWorx.
2. An annual domain renewal fee will be incurred.
3. The Domain registration fee is non-refundable, due to expenses incurred in the registration process.
4. If the domain name has already been registered, transfer fees may apply as proscribed by the current ISP holding the Domain.
E. Payment
1. Payment must be made within 7 days of date of invoice, unless otherwise agreed.
2. A deposit is due before the commencement of any work on your website.
3. Outstanding payments will accrue interest at the prime lending rate as determined from time to time by the South African Reserve Bank.
4. All domains, websites and related material remain the property of StudentWorx until all outstanding payments have been received.
F. Communication
1. Please note that our preferred mode of communication is via email. Alternative communication originating from StudentWorx will be done by SMS. StudentWorx is committed to minimising our support for Telkom. To that end, we prefer communication via email, sms, msn, or Skype. If you don't know how to use cheap VOIP technology, please ask us.
2. StudentWorx will endeavour to respond to all communication within 48 hours. If no response is received after this period, please resend your request to howcanwehelp@studentworx.co.za.
